Couple sued over sundeck collapse

December 13, 2004 A Nanaimo couple is being sued after their sundeck collapsed during a party.

Malcolm and Janet Hargrave were hosting a gift opening in July 2003, when their deck gave way, injuring 22 people.

Kyle Mutch of Langley says he received a concussion and several soft tissue injuries in the three-metre fall.

He's accusing the Hargraves of failing to make sure the deck was safe. The lawsuit says Mutch has lost physical abilities and income since the deck collapse. He's suing for expenses and damages.
